with crimes in the state and

GENERAL LITIGATION
AND DISPUTE
RESOLUTION
Various relationships in our lives
give rise to disputes which
require either litigation,
arbitration or mediation to
achieve a resolution. We are well
equipped and experienced to
assist you in such matters,
including business disputes,
construction litigation, trusts
and estate litigation, real estate
litigation, family law and
guardianship and
conservatorship matters. We
represent clients in federal and
state courts in Virginia.

MARRIAGE AND DIVORCE
Whether you need assistance
planning for a marriage by
counseling and preparation of a
prenuptial agreement or legal
representation in negotiating a
post nuptial agreement and
terminating a marriage, George
H. Dygert, David Heilberg and
Kelly A. Hobbs have proven
experience representing clients
in this area.

George H. Dygert, David
Heilberg and Kelly A. Hobbs

child custody matters and Ms.
Hobbs frequently serves as a
Guardian ad litem appointed by
the court to independently
represent the interests of the
children in custody proceedings.

PERSONAL INJURY
Mr. Heilberg, Mr. Wright and
Mr. Dygert, handle personal
injury cases resulting from
automobile, truck, motorcycle
and other accidents including
those that are not motor vehicle
related. If another party is
clearly at fault, we will consider
handling such cases on a
percentage contingent fee basis
(where our fee is a percentage of
what is recovered from
settlement or judgment).

EMINENT DOMAIN
If the Commonwealth of Virginia, a utility
company or a school district takes some
interest in your property for a public
purpose, you are constitutionally entitled
to just compensation for what has been
taken. We represent property owners in
condemnation proceedings in federal and
state courts.

BUSINESS FORMATION
Limiting individual liability and tax
liability considerations frequently lead us
to suggest the formation of a business
entity, whether it is a corporation, a
limited liability company or a partnership.
We can assist you in reviewing your
business objectives and selecting and
creating the legal entity that best meets
your needs.

REAL ESTATE
Our attorneys prepare and review real
estate sales agreements, our office
handles residential and commercial real
estate closings. We also advise and
represent clients in partition suits, quiet
title actions, boundary line disputes,
enforcement of restrictive covenants,
specific performance actions,
landlord-tenant issues and other matters
related to ownership interests in real
estate.

CONTRACTS
Contracts are an inescapable part of life;
real estate sales agreements and listing
agreements, construction contracts,
contracts for the purchase of personal
property, asset purchase agreements for
the sale of business assets, limited liability
company operating agreements, corporate
buy/sell agreements, leases, and
prenuptial or postnuptial agreements. It is
often better to consult an attorney before
you sign a contract than after the fact. We
can assist you in drafting and negotiating
any kind of contract.

PROFESSIONAL MALPRACTICE
Mr. Dygert, Mr. Wright and Mr. Heilberg
handle these cases against professionals
who cause damage to their former clients
or patients either by performing their
work negligently or by breaching
contracts. Such work, because of its
complexity, is often handled hourly. In an
exceptionally meritorious case, the
attorneys will consider undertaking client
representation on a percentage contingent
fee basis.

SOCIAL SECURITY DISABILITY
Mr. Heilberg and Mr. Dygert handle
disputed cases for clients who are denied
their disability benefits by the Social
Security Administration. Meritorious
cases are handled on a percentage
contingent fee basis drawn from the fund
of accrued back benefits resulting from
the sometimes long administrative delays
in obtaining benefits owed to deserving
clients.

CONSTRUCTION
We represent owners,
contractors, architects and
engineers in all aspects of
construction projects, including
the preparation of bid
documents, contracts and
subcontracts, working with
construction lenders and surety
companies, and the litigation and
resolution of various claims and
disputes, including delay claims,
changed or defective work
claims, nonpayment claims and
claims on performance and
payment bonds.

ESTATE PLANNING
We assist clients with the
planning of their estates to
ensure that their wishes for
distribution of their assets will
be carried out at their death in
an efficient and economic
manner, avoiding unnecessary
taxes and administrative fees.
We prepare wills, trusts,
advanced medical directives,
powers of attorney and other
documents which assist our
clients in planning for their lives
and effectuating their intent for
distributing their assets after
death.

ADMINISTRATION
Our attorneys provide legal
services to and may agree to
serve as executors or
administrators of estates to
assist families during the
probate process.

COLLECTIONS
We represent clients to obtain
judgments for money owed
them and for damages they
have suffered at the hands of
others. This includes preparing
the necessary papers for filing
with courts and conducting the
litigation to obtain judgments, as
well as collection activities once
judgments have been obtained.
When you receive a money
judgment, you may find that you
need some assistance enforcing
it. We can help you with debtor
interrogatories, garnishments,
levies, creditor bills and other
means of collecting money owed
to you.
